Why does the NCAA have a rule like this, that makes no sense in regards to NIL?

Jason Miller, UNC’s Reese Brantmeier’s attorney, on where they’re at with her case against the NCAA that will allow players from smaller sports to get the same advantages that players in bigger sports get. 

What was the argument that Jason raised? The court ruled that there was no harm to the competition in tennis or a host of non-revenue/Olympic sports. They also argued that the college events would be damaged by excluding her and athletes in similar situations. Did Jason argue the difference between NIL/endorsements and prize money?
